These Terms of Use govern your use of the Boat Data website, mobile app, and related services. By installing, accessing, or using the app, you agree to these terms. If you do not agree, do not use the app.

1. Scope

Boat Data is a marine information and navigation support application for personal and professional sailing use. The app provides vessel-data visualization, route and tide tools, AIS-related awareness features, notifications, and optional premium functionality.

2. License Grant

Subject to these terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to install and use Boat Data on devices you control for lawful purposes. No ownership rights are transferred to you.

3. Restrictions

• You may not copy, modify, reverse engineer, decompile, or attempt to extract source code, except where mandatory law permits it.
• You may not use the app to violate laws, marine regulations, or the rights of others.
• You may not interfere with security, licensing, or access control mechanisms.
• You may not resell, sublicense, or commercially redistribute the app without written permission.

4. User Responsibility And Safety

Boat Data is a support tool and does not replace official charts, instruments, seamanship, lookout duties, or navigational judgment. You remain responsible for safe vessel operation and for verifying critical information before making decisions.

5. Subscription And Premium Features

Some functions require a subscription or other app-store entitlement. If you buy Boat Data through Apple App Store or Google Play, the purchase is made through your platform account and the store's own terms, billing rules, and refund policies also apply.

• Subscriptions may auto-renew unless canceled in your Apple or Google account settings before the current period ends.
• Billing, cancellations, refunds, taxes, and receipt handling are managed by the respective app store.
• Boat Data receives only the entitlement or receipt status needed to unlock premium features.
• If you restore purchases, the app asks the relevant store to re-check your existing entitlements.

Availability, pricing, and feature access can vary by region, platform, and store policy.

6. Third-Party Services

The app may interact with third-party services and libraries such as marine data sources, map services, chart or visualization providers, and store infrastructure. Use of those services is also subject to their own terms and privacy practices.

Receipt and entitlement verification for subscriptions may use a validation provider such as Iaptic to confirm current access status.

7. Updates And Changes

We may update, modify, suspend, or discontinue features at any time to maintain compatibility, improve safety, address legal requirements, or evolve the product. Where reasonably possible, significant changes will be communicated through the app or release notes.

8. Intellectual Property

The app, website, branding, text, graphics, and software are protected by copyright and other intellectual property laws. All rights not expressly granted are reserved by the rights holder.

9. Disclaimer Of Warranty

The app is provided "as is" and "as available" to the extent permitted by law. We do not warrant that data will always be error-free, uninterrupted, or suitable for every sailing scenario.

10. Limitation Of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from app use. Mandatory consumer rights and liability rules remain unaffected where they cannot be excluded.

11. Termination

Your license ends automatically if you violate these terms or if the app is removed from the relevant store or discontinued. Sections that by nature should survive termination remain in effect.

12. Governing Law

Unless mandatory consumer protection law says otherwise, these terms are governed by the laws of Germany, and the competent courts are located where permitted by applicable law.
